At Mazaam Interactive Inc., we pay particular attention to protecting the privacy of our users. We respect the confidentiality of all personal information we collect.

Used Terms

Currently, Mazaam Interactive Inc. offers four platforms:

The Website: All available content at https://www.mazaam.com, including the website’s transactional interface and the subscription interface (My Mazaam space);
The App: The free version of our mobile app available in the App Store and on Google Play, and its paid version, Mazaam Premium, available through an in-app purchase from the app stores or after purchasing a membership to the Mazaam Academy;
The Mazaam Academy: The Website’s interface is intended for use by educators and teaching staff at schools and preschools. The user can sign up for free or for a paid subscription, which provides different levels of membership allowing access to: 1) pedagogical sheets of musical awakening activities; 2) Windows Software for PCs; 3) licenses to use the App;
The Software: The Windows version of the app for PCs and Chromebooks. It can be installed by users who have a valid paid subscription to the Mazaam Academy;
The Platforms : All four above-mentioned platforms.

The following terms are also used in this Privacy Policy:

Content: It is agreed that the definition of Content, used in the plural or singular form, designates the texts, sounds, music, videos, animations or other material available through the Platforms.

Child: it is agreed that the capitalized term Child, used in the singular or plural form (Children) in this Privacy Policy is defined as a person under 13 years of age.

Collecting Personal Information

The App and the Software

Mazaam Interactive does not collect personal information through the use of its App and its Software. At no point does Mazaam Interactive Inc. ask or will ever ask a Child to fill out a form requesting personal information.

Mazaam Interactive Inc. uses a third-party analysis system, the Unity game engine, which automatically collects anonymous data in order to track and analyze the use of the App. The information collected through this method cannot be used to identify the user of the App. Visit https://unity3d.com/legal/privacy-policy for more information on how this data is used.

The Website

For its Website, Mazaam Interactive Inc. also uses a web and mobile third party analysis solution, Google Analytics, which automatically collects anonymous data regarding the use of its Website. The information collected using this method cannot be used to personally identify the user who visits the Website.

The Website offers to its users the possibility of subscribing to a contact list, by filling out a form, and then receiving newsletters about activities related to Mazaam Interactive Inc. Mazaam Interactive Inc. uses the MailChimp mailing system to provide this service. To subscribe, the user must provide an email address, a first name and last name, which are collected and stored by Mailchimp. The Website has a subscription area called My Mazaam Space that provides specific Content accessible only to subscribers. To subscribe, the user must provide Mazaam with the following personal information:

First name
Last name
Email address
Name of school, daycare facility, or institution, if applicable.

The Mazaam Academy

To subscribe to a free version of the Mazaam Academy, the user must provide Mazaam Interactive Inc. with the following personal information:

First name
Last name
Email address
Voluntary information: Name of school and/or school service centre or school board, daycare facility, or other institution.

To subscribe to a paid version of the Mazaam Academy, the user must provide Mazaam Interactive Inc. with the following personal information:

First name

Payment information

The above-mentioned information is not only stored by Mazaam Interactive Inc., but is also gathered by the Stripe payment management system, which is used to process transactions on the Website and the Mazaam Academy. The products and Platforms of Mazaam Interactive Inc. contain sections that are for Children, but no personal information is collected from Children under any circumstances.

Advertisement and Marketing

Mazaam Interactive Inc. and its Platforms do not reveal any advertisements to Children, whether it be for Mazaam Interactive products or third party vendors.

Right to Access, Refuse and Withdraw

Mazaam Interactive Inc. is committed to providing you a right of refusal and withdrawal regarding your personal information. The right of refusal means the choice given to Internet users to refuse that their personal information be used to certain ends mentioned, while the information is being collected.

The right of withdrawal means the choice given to Internet users to request that their personal information be removed, for example, from the Mailchimp mailing list. Mazaam Interactive Inc. is committed to supply access and rectification rights to those concerned who wish to access, modify or delete their information.

Mazaam Interactive Inc. is committed to maintaining a high level of confidentiality by leveraging the latest technology in order to ensure the confidentiality of your transactions. Terms and Conditions

The terms of the contract can be modified or upgraded at any time. Additional conditions come into effect. These additions will apply automatically.

It is forbidden to access the Platforms from territories where legislation stipulates that the Content and Platforms are illegal. It is your choice to use the Platforms according to your own initiative and it is your responsibility to conform to all applicable local laws. Any claim relative to the Platforms and the elements they contain or that are derived from the usage of the Platforms is regulated by the laws applicable in the territory of the province of Québec (Canada).

Restrictions on Use

Unless otherwise specified in a section of the Platforms of Mazaam Interactive Inc., no element may be copied, reproduced, distributed, translated, downloaded, posted or transmitted in any manner whatsoever, without the prior permission of Mazaam Interactive Inc. or the holder of the copyright. You are permitted to post or download the elements of the Platforms, but only for non-commercial purposes, and providing you do not modify these elements and also maintain all notices of intellectual property they contain. All unauthorized usage of the aforementioned contents may result in civil and/or criminal liability.

Trademarks

The logos used or posted on the Platforms are owned by Mazaam Interactive Inc. or a third party. Nothing in the Platforms can be interpreted so as to permit, directly or indirectly, the usage of a logo reproduced on the Platforms without prior written permission from the owner of said logo.

Copyright

All Contents reproduced on the Platforms are protected by copyright as well as by intellectual property rights throughout the world. Unless otherwise stated, no element of the Platforms may be copied, reproduced, distributed, translated, downloaded, posted or transmitted in any manner whatsoever, without the prior written permission of Mazaam Interactive Inc. You are permitted to post or download the elements of the Platforms, but only for non-commercial purposes and providing you do not modify these elements and maintain all notices of intellectual property that they contain. All unauthorized usage of aforementioned contents may result in civil and/or criminal liability.

Limitation of Liability

The use of the Platforms requires a compatible system, Internet access, and certain software. The use of these Platforms could be affected by the performance of these elements. High speed Internet access is highly recommended. In accepting these conditions of service you acknowledge and accept the fact that these technical requirements are your responsibility.

Mazaam Interactive Inc. and the elements contained in the Platforms are provided as presented, without any expressed or implied warranty. Mazaam Interactive Inc. claims no warranty and assumes no liability and offers no warranty to the fullest extent permitted by applicable law, in particular concerning merchandise quality or suitability for a specific use. Moreover, Mazaam Interactive Inc. makes no claim relative to the usage, downloading, validity, preciseness or reliability of the elements reproduced on the Platforms or concerning the results deriving from the use of such elements.

Although Mazaam Interactive Inc. does everything possible for the Platforms to present no errors, Mazaam Interactive Inc. disclaims any responsibility relative to any error that could be encountered on them. Its affiliate companies, directors, employees, representatives and agents will in no case be held responsible for any damage related directly or indirectly to the use of the Platforms be it for loss of data or profit derived from the usage of the Platforms or the inability to use these elements. In the case of such an occurrence where the responsibility of the Platforms could be upheld in your favour, it will be limited to an amount equivalent to the price you paid for the faulty products. In spite of these restrictions, nothing in the present article can have as a consequence the limitation of any right that you might have as a consumer in virtue of the laws that could be applicable in your case.

Other Companies

The Platforms offers links to the sites of other companies. Mazaam Interactive Inc. is in no way responsible for examining, evaluating or warranting the sale offers made by these firms or individuals, or the content of their Web sites. Mazaam Interactive Inc. disclaims any liability for the actions, products and content of these parties or of any other third party. It is highly recommended that you read carefully their declarations of confidentiality, terms of use and other conditions of sale.

Authorization and Access to the Platforms

The Platforms cannot be reproduced, in whole or in part, copied, sold, resold, visited or exploited for any commercial purpose without the express written permission of Mazaam Interactive Inc. You are not authorized to use meta tags or any other “hidden text” using the name of Mazaam without the express written permission of Mazaam Interactive Inc.. You may, however, create a hypertext link that refers back to the homepage of the Website, the App or the Mazaam Academy as long as this link does not present Mazaam or its Platforms, its products or its services in a manner that is fraudulent, misleading, defamatory or otherwise offensive.

Applicable Law

The present contract on the conditions of service is governed by the laws applicable in the province of Quebec. It is understood that any litigation stemming from or linked to the use of Platforms of Mazaam Interactive Inc. will be submitted to the competence of the law courts of Montreal, province of Québec.

Indemnity Agreement

You agree to side with Mazaam Interactive Inc. should judicial proceedings against the company ensue from a violation of the present conditions of use by you or another user of your access to the Platforms.

Force Majeure (casus fortuitus)

Mazaam Interactive Inc. will not be held responsible for the non-fulfillment in full or in part of any of its obligations to you, or for damages or losses that you might have incurred if the non-fulfillment, damages or losses are the result of a force majeure or of circumstances beyond its control.

Licence to Use

Mazaam Interactive Inc. permits you to stream or to look at its products on the Platforms according to the following terms:

By installing, copying, or otherwise using the Platforms, you acknowledge that you have read and understood this Agreement and accept to be bound by its terms of usage. If you do not accept the stipulations of this Agreement or cannot conform to it, you are requested not to install, copy or otherwise use the Service, nor any music, image, video, text or other material available through the Platforms (“Content”).
You consent to not disassemble, decompile, dissect or otherwise tamper with security components, special rules or other security applications for any reason whatsoever. You accept to conform to the rules and policies periodically established by Mazaam Interactive Inc. These rules and policies will usually be applied in a non-discriminatory manner to the users of the Platforms and may include, for example, required or automatic updates, modifications, and (or) reinstallations of the Software, as well as the App, of patches to handle problems of security, interoperability and (or) performance.
You accept to not use the Content for purposes that could conflict with the copyrights associated with it.
The Platforms allow you to obtain, listen to, watch and (or) read (depending on the case) the Content digitally, for personal and non-commercial use, for the sole purpose of entertainment. This Content may belong to Mazaam Interactive Inc. or to a third party. However, in all circumstances, you understand and accept that your rights of usage of the Content are limited in virtue of the copyright law. You accept and will not attempt to modify the Platforms or Content obtained through the Service, for any reason whatsoever, including that of falsifying or changing the identity of the owner or the source of the Content.
You represent, accept and guarantee that you will use the Platforms only for your personal, non-commercial, entertainment purposes, and not as a means of redistribution. You agree to not distribute, reproduce, or publicly display any of the Content or transfer copies of the Content obtained through these Platforms.
Mazaam Interactive Inc. can periodically remove Content from the Platforms without prior notice.
Mazaam Interactive Inc. is the intended beneficiaries of this Agreement and has the right to have it respected.
The Platforms, including all Content and other information, material and products included or placed at your disposal by means of the Platforms are provided to you on an “as is” and “as available” basis, with no warranties from the provider of services or the owners of the Content. To the fullest extent permitted and in virtue of the applicable laws, the provider of services and all the owners of the Content disclaim all warranties, implicit or explicit, concerning the quality of the merchandise and serviceability for a particular purpose. No provider of services or any owner of Content can guarantee that the service or the content, the information, equipment or products included or placed at your disposal through the service will be exempt of viruses or other dangerous obstacles.
Mazaam Interactive Inc. shall not be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, arising out of or in connection with use of its Platforms or its Content, information, equipment or products included or put at your disposal through the Platforms, or in case of damages with costs in excess of the amount paid for the utilisation of the Content associated with the request for indemnization of damages. However under all circumstances, you understand and accept that your rights to use the Content will be limited under the Copyright Act. You accept that you will not attempt to modify the Platforms or Content obtained through the Platforms, for any reason, including the falsification or change of identity of the owner or source of the Platforms or Content.
